Attentis Pty Ltd. ("We" or the "Company") respects your privacy and is committed to protecting it through our compliance with this policy. This Privacy Policy describes the types of information we may collect from you or that you may provide when you register user account access to either our LVIN.org or attentistechnology.com websites and details our practices for collecting, using, maintaining, protecting and disclosing that information. We hope that reading our Privacy Policy helps you understand how we manage information about you and the measures we take to protect it.

Except where noted, statements in this Privacy Policy with respect to the LVIN.org and attentistechnology.com sites apply to both our web and mobile applications, and any tools or applications contained within the LVIN.org or attentistechnology.com sites. By downloading, accessing or using these applications, or providing information to us in connection with them, you agree to the terms and conditions of this Privacy Policy, so please read on carefully.

How we collect and use your information

Personal information

When you sign up for a registered user account with either LVIN.org or attentistechnology.com, we may ask you for personal information. "Personal Information" means information that we can use to identify or contact you, such as your name, address, telephone number and email address. We may combine the information you submit under your account with information you enter later to provide a better experience and to improve the quality of our services, i.e. information that is relevant to or specific to your registered location. For certain services, we may give you the opportunity to opt out of combining such information. We may also contact you regarding updates about our services, new services, and new features as well as important changes to this policy.

We may disclose personal information to: credit reporting agencies and courts, tribunals and regulatory authorities where customers fail to pay for goods or services provided by us to them; courts, tribunals, regulatory authorities and law enforcement officers as required by law, in connection with any actual or prospective legal proceedings, or in order to establish, exercise or defend our legal rights; third parties, including agents or sub-contractors, who assist us in providing information, products, services or direct marketing to you. This may include parties located, or that store data, both inside and outside of Australia; and third parties to collect and process data including Google Analytics. Where we disclose your personal information to third parties for these purposes, we will request that the third party follow this Privacy Policy regarding handling of your personal information.

Sensitive information

Sensitive information is data collected by our sensors at customer sites or locations that may be sensitive in nature or proprietory to an operation or specific to that particular site or customer. Sensitive information forms part of the data we collect during our normal operations at a range of sites. As part of normal operations we gather, collate and process site specific sensitive information that is accessible on our interfaces. Sensitive data forms part of our specific client offering and services and is not available to any other users, only users that have secured sign-in access to that individual network or sensor. All sensitive information gathered, collected, collated or displayed remains the property of the customer. In referring to 'sensitive information' we mean information that relates to site visual and thermal images, air quality composition, structural integrity, audio, movement, and specific sensing requirements for each individual location. Sensitive information will be used and disclosed for purposes relating to the primary purpose for which the sensitive information was collected. Sensitive information will only be accessed or disclosed to persons without secured sign-in access if required by law to disclose.

Non-sensitive information

Non-sensitive information is information of a general nature and is defined as weather information including but not limited to wind speed, wind direction, relative humidity, rainfall, barometric pressure, solar irradiance, UV measurements, delta T calculations, spray drift analysis and air movement. All non-sensitive information is and remains the property of Attentis Pty Ltd. We collect this data in order to provide all registered Attentis users, subscribers and clients with information that can be used to improve situational awareness, understanding, long term conditions, and changes in localised and wide scale conditions. We also use this data in an aggregated, collated format to analyse environmental behaviour and activity to improve the LVIN.org and attentistechnology.com sites (e.g. refining correlation algorithms). In some cases, non-sensitive data is shared between our customers to provide wider ranging information to improve situational awareness and provide greater understanding of conditions that impact operations, organisations, individuals and communities.

Non-personal information

In order to improve and optimise user interaction on our LVIN.org and attentistechnology.com sites, our servers automatically collect information about your interactions on our site, including, without limitation, pages viewed, data accessed, depth of historic information accessed, search terms, internet protocol address, browser type, browser language, and the date and time of your ingress and egress.

User communication

When you send email or other communications to Attentis, we may retain those communications in order to process your inquiries, respond to your requests and improve our services. We may use your email address to communicate with you about our services, new features, changes to access, the creation of additional networks, access to new networks and other correspondence as required from time to time.

Choice and consent

Providing us with certain personal information is optional to you. You can choose not to provide addresses and multiple contact phone numbers, however we do require your full name, email address, a contact phone number and your postcode to establish a registered user account. If you are accessing any of our sites in a corporate capacity or as part of your job / role / project / investigation, the organisation with whom you are representing or under contract or obligation with must be revealed when establishing the user account. Changes in employer, contract or engagement arrangements must be updated on the site. Due to the fact that our sites deal with sensitive information and we endeavour to protect all information available on the site, we must be aware of any changes as it may breach our privacy policy and place sensitive information at an unacceptable risk. Users failing to comply with this requirement will have all access removed and the circumstances surrounding the account termination reviewed by Attentis and its legal representatives. When you provide us with your personal information, you consent to the terms in this Privacy Policy, and to us disclosing or receiving your personal information for these purposes.

How we handle privacy and security internally

Attentis seeks to use reasonable physical, technical and administrative measures to protect personal information and data information under our control. Unfortunately, no data transmission over the internet or data storage system is guaranteed to be 100% secure, and although all endeavours are made to protect all data housed by Attentis, we cannot be held responsible for breaches relating to access to data and personal information. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please notify us immediately by contacting us to allow us to address and rectify the breach in the fastest possible timeframe.

Access

You may request details of personal information that we hold about you, in certain circumstances set out in the Privacy Act 1988 (Cth). An administrative fee may be payable for the provision of information. We may refuse to provide you with information that we hold about you, in certain circumstances set out in the Privacy Act.

Correction

If you believe that any information we hold about you is inaccurate, out of date, incomplete, irrelevant or misleading, please update your information on your account or contact us by email to ensure that the details we have are up to date and correct. We rely in part upon users advising us when their personal information changes. We will respond to any request within a reasonable time. We will endeavour to promptly correct any information found to be inaccurate, incomplete or out of date.

Changing or removing information

If you would like to update the personal information that you have provided to us, you may do so through accessing your account, updating the information and by selecting save, updating that information. Alternatively you can send us an email with the required changes and Attentis administration will make those changes for you and send you confirmation that this has occurred. If you would like to delete your personal information from our systems, you should contact us following the directions in the "Contact us" section requesting the user account be closed and Attentis administration will close your account. Account closure will be performed within 48 business hours, or as soon as possible, should the request fall outside these normal parameters.

Sharing your information

We only share personal information with other companies or individuals outside of Attentis Pty Ltd. in the following limited circumstances:

We have your consent. We require opt-in consent for the sharing of any sensitive personal information.

We have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process or enforceable governmental request, (b) enforce applicable Terms and Conditions of Use, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against harm to the rights, property or safety of the Company, its users or the public as required or permitted by law.

If Attentis Pty Ltd or a network owned, controlled or managed by Attentis becomes involved in a merger, acquisition, or any form of sale of some or all of its assets, Attentis shall have the right to transfer your information in connection with that transaction and / or network. Attentis will provide notice on the Site in the event of such a transfer.

Third parties

This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties operating any software application or website to which the LVIN.org or attentistechnology.com contains a link. The inclusion of a link on either LVIN.org or attentistechnology.com site does not imply endorsement of the linked software, application or website by us or by any of our affiliates.

Changes to this policy

Please note that this Privacy Policy may change from time to time. Revised Privacy Policy statements will be available including highlighted altered sections. In the event that the changes are significant, a notice including the highlighted changes will be emailed to all users.

Jurisdiction

Attentis Pty Ltd is an Australia company and therefore; accordingly, this Policy, and our collection, use and disclosure of your Personal, sensitive and non-sensitive information, is governed by Australian Law, and not by the laws of any country, territory or jurisdiction other than the Australia. We do not represent or warrant that the LVIN.org and attentistechnology.com or any functionality or feature thereof is appropriate or available for use in any particular jurisdiction. Those who choose to access or use LVIN.org and / or attentistechnology.com do so on their own initiative and at their own risk, and are responsible for complying with all local laws, rules and regulations. By using the LVIN.org and / or attentistechnology.com sites and submitting any personal information, users from outside Australia acknowledge that Attentis Pty Ltd is subject to Australian law and consent to the transfer of personal information to the Australian law, which may provide a different level of data security than in their country of residence, and waive any claims that may arise under their own national laws.
